Welcome to Shiny, the ultimate app for trading card enthusiasts! Whether you're a seasoned collector with a vault of rare finds or just starting to explore the world of trading cards, Shiny is your go-to tool for tracking, researching, and trading your favorite collectibles. We know that the thrill of the hunt is just as exciting as the trade itself, and we're here to make that experience seamless and fun.

Owned and operated by Shiny Cardboard LLC ("Company," "we," "us," or "our"), Shiny helps collectors like you stay organized, informed, and connected with other traders across the world. These Terms of Service ("Terms") govern your access to and use of the Shiny mobile application ("App") and all related services provided through it.

By accessing or using Shiny, you agree to be bound by these Terms. If you do not agree to these Terms, do not use Shiny.


Eligibility

Shiny is available globally to users who are 13 years of age or older. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. If you are under the age of 18, you must have parental or guardian permission to use Shiny and all services provided by Shiny Cardboard LLC.


Description of Services

Shiny provides users with a robust set of features designed to enhance their trading card experience, including:

  • Card Tracking - Users can digitally log and manage their physical trading card collections, keeping track of card details, conditions, and values.

  • Market Data & Research - The App provides access to real-time and historical market data, enabling users to monitor price trends, view card statistics, and make informed trading or purchasing decisions.

  • Marketplace - Users can list trading cards for sale, purchase, or trade, similar to an online marketplace. Listings can include card descriptions, photos, and price details.

  • User Accounts Across Devices - Users can create and access their Shiny accounts on multiple devices via Google Play and Apple App Store, ensuring seamless access to their data.

  • Notifications & Alerts - Users can set up personalized alerts for price changes, market trends, and new listings that match their interests.

  • Community Features - The App fosters engagement through user profiles, commenting, and rating systems to enhance trust and communication among traders.

We reserve the right to modify, enhance, or discontinue any features of the App at any time without notice.


Account Registration and Security

  • To use certain features, you must create an account.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You agree to provide accurate and current information and to update it as necessary.

  • We are not responsible for unauthorized access to your account.

  • You may not share, transfer, or sell your account to another person.


Acceptable Use and User Conduct

Users must adhere to the following acceptable use guidelines when accessing and using Shiny:

Prohibited Activities

You agree that you will not:

  • Use the App for any illegal, fraudulent, or unauthorized purpose or violate any applicable laws, regulations, or third-party rights.

  • Post, list, or distribute fraudulent, misleading, counterfeit, or stolen goods.

  • Engage in harassment, abuse, threats, hate speech, discrimination, or any harmful behavior toward other users.

  • Attempt to hack, reverse engineer, or disrupt the App’s functionality, servers, or databases. This includes the use of automated bots, scrapers, or any other means to collect user data, operationally collected data or interfere with the App’s services.

  • Impersonate any individual, entity, or falsely represent your affiliation with another person or organization.

  • Upload or transmit viruses, malware, or any malicious code that may interfere with the normal operation of the App.

  • Post, share, or distribute unauthorized commercial content, spam, or advertisements unrelated to trading cards.

  • Attempt to manipulate the marketplace by creating fake listings, price gouging, or engaging in fraudulent activities.

User Content and Responsibilities

  • You are solely responsible for any content (such as images, descriptions, or messages) that you post on Shiny.

  • You must ensure that any trading cards listed are accurately described and not misrepresented.

  • You acknowledge that Shiny does not pre-screen content, but we reserve the right to remove any content that violates these Terms.

  • By posting content, you grant Shiny Cardboard LLC a non-exclusive, worldwide, royalty-free license to display and distribute the content within the App.

Community Interaction

  • Users must engage respectfully with others within the community.

  • Any form of bullying, harassment, or malicious behavior may result in account suspension or termination.

  • Users can report inappropriate behavior or fraudulent activities, and we will review such reports at our discretion.

Enforcement of Policies

  • Shiny reserves the right to monitor user activity to ensure compliance with these guidelines.

  • Violations of this section may result in temporary or permanent suspension of an account, and complete forcible removal of any or all account data with or without your permission.

  • We may take legal action if unlawful activity occurs through the App.


Buying, Selling, and Trading

  • Shiny acts as a platform and does not guarantee transactions between users.

  • Users are solely responsible for verifying product authenticity and completing transactions.

  • We do not offer payment processing services; transactions occur externally through third-party payment providers at the private decision between both transacting parties; the buyer and seller.

  • We are not liable for fraud, disputes, or losses arising from trades conducted through the platform. It is the responsibility of the buying and selling parties to perform due diligence and authentication of items and payments during any and all transactions.

  • Users acknowledge that all communications and transactions related to listed items are conducted privately between the parties involved. We do not monitor or intervene in user interactions in any capacity.

  • Shiny does not take responsibility for any private agreements, disputes, negotiations, or issues that may arise between users regarding a transaction.

  • Shiny will not mediate or step in to settle any disputes between buyers, sellers, or traders. Users must resolve conflicts independently.


Subscriptions & Lifetime Access

Subscriptions to Shiny, including upgrades such as Shiny Pro, are managed through the Apple App Store and Google Play Store. All subscription billing, cancellations, and refund requests must be handled directly through the respective store from which you made your purchase, in accordance with their policies. For users who purchase a lifetime license for Shiny Pro, “lifetime” refers to the continued availability and support of the Shiny application under its current name (“Shiny”). Lifetime access does not guarantee availability of the application indefinitely and will end if the Shiny application is discontinued, materially altered, or replaced under a different name. The Shiny Pro upgrade, including lifetime access, may be revoked, rate-limited, throttled, or discontinued at any time at our sole discretion, including but not limited to cases of misuse as determined by us, violation of these Terms, technical limitations, or as otherwise deemed necessary. Features or services described as “unlimited” are marketed as such to indicate the absence of a predetermined fixed limit under conditions of normal personal use. Unlimited features remain subject to fair use, technical limitations, and cost considerations, and may be restricted where an individual user’s activity materially exceeds what we consider reasonable personal use, or otherwise impacts the sustainability, performance, or integrity of the service.

Card Scanning

Card scanning functionality is included with Shiny Pro subscriptions and lifetime licenses and is marketed as “unlimited.” For clarity, “unlimited” refers to the absence of a predetermined fixed number of scans under conditions of normal personal use. All scanning activity is nevertheless subject to fair use, technical limitations, and cost considerations. We may, at our sole discretion, implement rate limiting, throttling, or other restrictions where an individual user’s scanning activity materially exceeds what we consider to be reasonable personal use, or otherwise impacts the sustainability, performance, or integrity of the service. Unlimited access does not entitle any user to unconstrained or unregulated scanning, and we reserve the right to modify, suspend, or discontinue scanning features as necessary.

Intellectual Property

  • Shiny and all associated content, trademarks, and intellectual property are owned by Shiny Cardboard LLC.

  • You may not copy, modify, or distribute any part of the App without express written permission.


Termination of Services

We reserve the right to suspend, disable, or terminate access to the App at our discretion, including if a user violates these Terms.


Disclaimers and Limitation of Liability

  • Shiny is provided on an "as is" and "as available" basis. We make no warranties about accuracy, reliability, or availability.

  • Shiny displays market data and pricing information for trading cards, which is provided for informational and research purposes only.

  • The pricing information presented in the App does not constitute investment advice, financial advice, or recommendations for buying, selling, or trading.

  • Users acknowledge that market values fluctuate and that Shiny does not guarantee the accuracy, timeliness, or completeness of the data provided.

  • Users assume full responsibility for any trading or purchasing decisions they make based on the information available in the App.

  • We are not responsible for losses, damages, or issues arising from your reliance on the market data provided within the App.

  • To the maximum extent permitted by law, our liability is limited to the amount you paid to use the App (if any).


Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of Nevada, without regard to conflict of law principles.


Changes to These Terms

We may update or modify these Terms at any time, in our sole discretion, to reflect changes in our services, features, business practices, legal requirements, or for any other reason. Unless otherwise required by law, updates will be effective immediately upon posting the revised Terms within the App or on our website. In the event of material changes, we may provide additional notice to users via in-app notifications, email, or other reasonable communication methods.

Your continued use of Shiny after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the modifications, you must discontinue your use of Shiny immediately.

Changes may include, but are not limited to:

  • Updates to user rights and responsibilities.

  • Modifications in payment or subscription policies.

  • Adjustments to marketplace rules and acceptable use guidelines.

  • Enhancements, limitations, or discontinuation of certain features.
